What is Consignment of Copyright?

We do not recommend Consignment of Copyright but we are open to discuss requests.

Consignment of Copyright is the act of giving permission to another organization or group to print or publish a manuscript under a copyright of their name. That means that we give them permission to remove the IPS Copyright from the printed book.

While there may be some rare cases where this could be justified. There are very few situations where material can not be effective if published under the IPS copyright. The Consigning of Usage & Distribution Rights usually allows enough permission for IMB personnel and other groups to accomplish their goals without the need to Consign the Copyright. 

The Consignment of Copyright agreement contains other restrictions concerning number of copies to be printed, limits on where the copies can be distributed and other restrictions that will be made clear in the Consignment of Copyright agreement. If granted, permission is usually granted with a limited specified period time. 

 

 

 

 

 

 

 

 

 

 


What is Consignment of Usage & Distribution Rights?

Consignment of Usage & Distribution Rights is the act of giving another organization or group the permission to use IPS materials. This permission usually involves their desire to print a certain number of copies of a manuscript that they want to use in a project they are doing. If permission is granted, they would print the material under the original IPS copyright and with the original authorship.  Permission is usually granted to print up to a fixed number of copies within a specified period time. Usage rights do not include permission to change the copyright. There are other restrictions that will be made clear in the Publications & Usage Agreement. (That is the agreement used to consign usage and distribution rights.)
  



























Instructions to Complete this Publishing & Usage Agreement.
This Agreement is to be used for Non-IMB Licensees Only

1. The (IMB) Strategy Coordinator or equivalent for language group or location completes the Agreement by entering the requested information in the Blue Areas.


2. The Strategy Coordinator or equivalent sends the Agreement by E-mail to Licensee Contact Person and the IPS Director(consign@jimbrock.com)

3. The Licensee Contact Person completes the Agreement by entering in the requested information in the Red Areas.

4. The Licensee Contact Person sends the Agreement by E-Mail to the Strategy Coordinator or
equivalent for language group or location and the IPS Director(consign@jimbrock.com)


5. The IPS Director will review and complete the Agreement by entering the requested information in the Green Areas.

6. The IPS Director sends the Agreement by E-Mail to the Strategy Coordinator or
equivalent for language group or location and the Licensee Contact Person.


7 When 1-6 have been completed the Agreement is in force from the date of the e-mail signing of the IPS Director.

8. All parties should print and keep a hard copy of the final copy of the Agreement.
Please note that a Renewal of Agreement is included in this form to make it easier for you to
Renew this Agreement. It should not be completed until such time as the Strategy Coordinator
or equivalent for language group or location desires to Renew the Agreement. That desire must also be communicated to the IPS Director in a separate E-Mail other than the Renewal form.

PUBLISHING AND USAGE AGREEMENT

1. Permission is hereby granted by International Publications Services (IPS)
(hereinafter called Licensor), P. 0. Box 1759, Edenvale 1610, South Africa, to:

Place the name of the Person or Organization you want to allow to print and use the materials, and their mailing and email address.
(hereinafter called Licensee)

to publish: Name of the IPS Manuscript and the IPS Manuscript Code

in the: Name of Language Language

number of copies: Number

for distribution in the primary market area of: Country or Region


2. Licensee is responsible to see that each book will carry, in English and the used language,
the Original Copyright line for IPS and add to that line, "All Rights Reserved and Used by Permission."

3. The Licensee will send a sample of the cover and the copyright page for approval by IPS prior to printing.

4. Licensee will take appropriate steps to copyright their editions in their area of distribution.

5. Licensee will not sell translation and/or publishing rights to these titles.

6. Distribution will be limited to location listed above as the primary market areas.
(This is not a worldwide distribution agreement.)

7. Licensee will give to IPS the following product information for each title published as soon as it is available. This information will become part of the this agreement and is binding.
a. Two copies of the printed product.
b. Local retail price and U. S. dollar equivalent.
c. Projected availability date.
d. Source from which copies may be purchased.
e. The number of copies printed and cost of printing.
f. Cost to IPS if they want to buy additional copies.

8. A royalty payment of 10% of retail price of all copies printed or 10% of the cost of printing for materials that will be distributed at "no cost" will be paid to IPS within three months of printing. However, on condition that the above requirements numbered 2 through 7 are met by Licensee, all royalty payment will be waived.

9. Licensor shall have the right to immediately terminate this agreement if Licensee violates the terms of this Agreement, and this Agreement shall terminate at the end of 1 year from the date hereof signed by the IPS representative unless renewed by written agreement of IPS and Licensee.

10. Regardless of the location of the signatories of this agreement it shall be considered to be executed in the location of the home office of the owner of IPS, being the State of Virginia, United States of America. All parties agree that any legal resolution required by this agreement shall be settled in the courts and under the laws of the State of Virginia.

Renewal of Publications & Usage Agreement

1. The above agreement is hereby renewed for a period of one-year from the date of signing by the IPS Director of the Original Publications & Usage Agreement .

2. The above Agreement includes the additional printing of number of _____ copies of the same product as covered in the original Agreement.
(If there is to be no additional printing place "Zero" as the number of copies.

3. A royalty payment of 10% of retail price of all new copies printed will be paid to IPS within three months of printing the copies mentioned in 2. of this Renewal Agreement. However, on condition that the above requirements numbered 2 through 7 of the Original Agreement are met in regard to the new copies printed as mentioned in 2. of this Renewal Agreement by Licensee, all royalty payment will be waived.

4. All conditions of the Original Publications Agreement shall be included in this Renewal of Publications Agreement.

1. The Strategy Coordinator or equivalent for language group or location completes the Agreement
by entering the requested information in the Blue Areas.

This agreement can only be requested by persons currently serving as Team, Cluster, or Regional Strategy Coordinator or above. Individuals working with a people or in a local area may not request a agreement directly IPS. You should discuss you desires for an agreement with your SC first. Then your SC can request an agreement directly from IPS. We require that the SC be the person requesting agreements because they are charged with having a responsibility that is greater than the local situation.

 


8. All parties should print and keep a hard copy of the final copy of the Agreement.
Please note that a Renewal of Agreement is included in this form to make it easier for you to
Renew this Agreement. It should not be completed until such time as the Strategy Coordinator
or equivalent for language group or location desires to Renew the Agreement. That desire must also be communicated to the IPS Director in a separate E-Mail other than the Renewal form.

The renewal form is included to make a renewal easier for you as the SC to request. We do require that the SC complete the form and send it to us. We ALSO require that the SC send us a separate email informing us of their desire to extent the agreement and informing us that the renewal form in being sent.

 



2. Licensee is responsible to see that each book will carry, in English and the used language,
the Original Copyright line for IPS and add to that line, "All Rights Reserved and Used by Permission."

This means that the books will be printed with the exact original of the copyright that is in the original of the book. Also that a translation in the language used will also included on the copyright page. It is important to note that a copyright notice is now incomplete if it does not have the words, "All Rights Reserved".

The words, "Used with Permission" will also be place under the copyright notice(s).

 

 


3. The Licensee will send a sample of the cover and the copyright page for approval by IPS prior to printing.

This means that PRIOR to printing the book the person/organization you have requested have permission to print and distribute our book will send us a copy of the cover and the copyright page for IPS approval. To make this easier on everyone, we will gladly accept these by E-mail Attachment to the same address used in executing the Publishing and Usage Agreement.

Please note the importance of the words "for approval by IPS prior to printing". This means that everyone agreed that IPS does have approval or disapproval right over the cover that is used and the layout of the copyright page.

 

 

 


4. Licensee will take appropriate steps to copyright their editions in their area of distribution.

In some countries the government requires that all book printed in the country be registered with a government office. This is done differently from country to country and is part of the copyright protection process in that individual country. This mean that the Licensee will be responsible to determine what requirements apply in the distribution area and comply with those regulations.

 

 

 


5. Licensee will not sell translation and/or publishing rights to these titles.

This agreement is between the Licensee and IPS. Only IPS has the right to grant a Publications and Usage Agreement. SC level personnel of the IMB may request agreements from IPS but, they may not grant an agreement.

A Publishing and Usage Agreement does not grant anyone or any organization the permission to give any other person or organization permission to print or publish copies of IPS manuscripts.

 

 


6. Distribution will be limited to location listed above as the primary market areas.
(This is not a worldwide distribution agreement.)

Permission is granted for a limited distribution area. That area should be clearly defined in the agreement by the requesting SC. This mean that the Licensee may not send copies of the books for distribution outside of the defined area. We are often asked about sending sample copies to friends who live outside the distribution area. Sorry, that is not allowed in the agreement. Yes, that mean even one copy. To do so is a violation of the agreement and construes Copyright Violation.

 

 

 


7. Licensee will give to IPS the following product information for each title published as soon as it is available. This information will become part of the this agreement and is binding.
a. Two copies of the printed product.
b. Local retail price and U. S. dollar equivalent.
c. Projected availability date.
d. Source from which copies may be purchased.
e. The number of copies printed and cost of printing.
f. Cost to IPS if they want to buy additional copies.

This is a list of all that the Licensee agrees to provide IPS. With the exception of the two sample copies, everything may be sent by E-Mail to IPS using the same address as was used for the agreement. No, IPS will not pay for the two sample copies of the printed product or for the postage.

 

 


8. A royalty payment of 10% of retail price of all copies printed or 10% of the cost of printing for materials that will be distributed at "no cost" will be paid to IPS within three months of printing. However, on condition that the above requirements numbered 2 through 7 are met by Licensee, all royalty payment will be waived.

This is our way of getting the Licensee to send us the information and sample copies mentioned in section 7. We don't want your money. We want the information and the samples. Two mailed copies and a couple of E-mails are very easy and much cheaper than 10%.

 

 

 


9. Licensor shall have the right to immediately terminate this agreement if Licensee violates the terms of this Agreement, and this Agreement shall terminate at the end of 1 year from the date hereof signed by the IPS representative unless renewed by written agreement of IPS and Licensee.

This means that IPS can terminate this agreement at anytime we believe that the Licensee has violated any section of the agreement. This will be done by send a notice to the same email address used by the Licensee in executing the agreement. At that time, any further printing or distribution of printed materials will be a Copyright Violation.

 


10. Regardless of the location of the signatories of this agreement it shall be considered to be executed in the location of the home office of the owner of IPS, being the State of Virginia, United States of America. All parties agree that any legal resolution required by this agreement shall be settled in the courts and under the laws of the State of Virginia.

This means that the agreement is executed under the Copyright laws of the State of Virginia. And, as a result this agreement also falls under the Copyright laws of the United States of America. Should there be a Copyright Violation by any party of this agreement then, if IPS deems it necessary to resort to legal settlement, the location of that settlement will be in the courts of the State of Virginia.

This means that this is a legal contract. Please take that seriously. IPS does.

This mean that IPS will consider this agreement binding on the Licensee organization and that the "Contact Person" signing the agreement has the authority to sign for the Licensee Organization.

 

 

 


Renewal of Publications & Usage Agreement

1. The above agreement is hereby renewed for a period of one-year from the date of signing by the IPS Director of the Original Publications & Usage Agreement .


To make things easier for our SC people we include attached to the original agreement a form to request the renewal of the agreement for an additional year. This form should be completed before the first year of the agreement expires. This renewal can only be requested by the SC not the licensee or anyone else.

If approved, all the conditions of the original agreement will apply to the renewal.

 

 

 

 

 

 

 

 

 


Copyright Exceptions
There may be some situations where the complete removal of the IPS copyright may be desired.
This is considered a very rare exception and is rarely granted because it requires IPS to take some costly steps to protect the copyright of the manuscript. This costs IPS +-$50. USD for each manuscript. The expenses will be paid by the requesting Team, Cluster or Region.

Requests for Copyright Exception requires both the recommendation of the SC and Regional Level SC of the requesting area prior to our considering it.
